1. Provider and business-only scope
epostAI is provided by BYGGAI AS, organisation no. 933 941 116 VAT, Øvre Nedmarken 12, 3370 Vikersund, Norway (“BYGGAI”). Contact [email protected]. The service is offered only to businesses and persons acting in a professional capacity, not consumers. The person ordering confirms authority to bind the customer organisation (“Customer”).
2. Contract formation
A website submission is an order request, not a binding order. A binding agreement is formed only when the Customer has accepted in writing the price, plan, users, commitment, renewal and these terms, and BYGGAI then confirms the order in writing. Technical account activation alone does not form a contract. The Customer can correct data before submission. Agreements may be concluded in Norwegian or English; BYGGAI stores the confirmation and applicable terms. The final electronic order flow must be tested separately before self-service ordering is enabled.
3. Service
epostAI is a cloud AI service for Microsoft Outlook and Microsoft 365. Core functions may include summaries, reply drafts, tone improvement, translation and action points. Optional modules may include inbox prioritisation, sorting suggestions or folder actions, Outlook drafts, calendar suggestions, rules and follow-up. Access depends on the plan, Microsoft consent and enabled modules.
4. Human review and AI limitations
AI output is a suggestion and may be wrong, incomplete or misleading. The Customer and user must verify recipients, facts, amounts, deadlines, professional conclusions and all other content before use.
Customer-mailbox functions and the sorting agent do not use Mail.Send and do not automatically send ordinary customer email. Drafts must be reviewed and sent by the user. A separate administrator service may use Microsoft Graph sendMail for epostAI invitations. When the Customer enables agent modules, a user-triggered run may automatically move messages, execute rules or create tentative calendar events without attendees; actions are logged and may be undone where supported.
The service is not legal, financial, HR, health, safety or other professional advice.
5. Microsoft environment
The Customer needs a supported Microsoft 365/Outlook account, required licences and an environment permitting installation and consent. Optional functions may require Microsoft Graph permissions approved by the user or administrator. The Customer controls its tenant, users, internal policies and removal of access.
6. Accounts and security
Access is personal and must not be shared. The Customer must provide accurate information, protect accounts and report suspected misuse or incidents promptly. BYGGAI may require Microsoft sign-in, admin approval and additional safeguards, and may suspend access for security risk, misuse, non-payment or material breach.
7. Licence
The Customer receives a limited, non-exclusive, non-transferable and time-limited right to use epostAI for internal business purposes during the term, for the users and modules stated in the order. The Customer must not resell, sublicense, copy, bypass controls, reverse engineer except where mandatory law permits, security-test without written permission or use the service to develop a competing model or service.
8. Acceptable use and customer responsibility
The Customer may process only data it lawfully controls and must determine the legal basis, instructions, review and use of output. The service must not be used for unlawful content, spam, harassment, discrimination, malware, security circumvention, infringement or solely automated decisions with legal or similarly significant effects.
Health data, personnel matters, criminal records, payment-card data, passwords, authentication keys and similarly sensitive content require a documented legal basis, risk assessment, data processing agreement and safeguards agreed with BYGGAI AS.
9. Customer data and privacy
The Customer retains all rights in Customer data and grants BYGGAI only the limited right to process it to provide, secure and support the service under the agreement and instructions. Where BYGGAI processes personal data for the Customer, the Customer is controller and BYGGAI processor. A completed DPA and signing process are not documented in this website package; the service must not be used for such production processing until a DPA has been prepared, reviewed and entered into. See the Privacy Notice.
10. AI and third-party providers
epostAI relies on external providers for Microsoft services, AI, hosting and the website. The current production AI provider is the OpenAI API. BYGGAI does not use Customer content to train its own models. OpenAI states API data is not used for training unless the customer explicitly opts in. BYGGAI remains responsible for its provider choices and processor duties but cannot guarantee uninterrupted operation of external services outside its reasonable control.
11. Price and payment
Price follows the order confirmation or agreed order page. Prices are in NOK excluding VAT unless explicitly stated. Payment deadline and billing period appear on the invoice or confirmation. Monthly plans are billed in advance monthly; annual plans in advance for 12 months. Added users/modules may be billed pro rata or from the next period. Late interest and collection costs may be charged under law, and service may be suspended after notice. Fees for a commenced period are non-refundable unless agreed or required by mandatory law.
12. Term and cancellation
A monthly plan renews one month at a time until cancelled before the next billing period. An annual plan has a 12-month commitment and renews for further 12-month periods unless cancelled in writing at least 30 days before expiry. The order may specify different rules. Cancellation is sent to [email protected] and confirmed in writing.
13. Material breach and termination
A party may terminate for material breach not remedied within 14 days after written notice. No cure period is required for serious security breach, unlawful use, insolvency or irremediable breach. On termination, access ends. Before the end date, the Customer may request a reasonable export of stored data in an available standard format. Data is deleted under the DPA and Privacy Notice.
14. Support, maintenance and availability
Support is provided through [email protected] and the Support page. Unless a separate SLA applies, support and availability are best effort without guaranteed response time or uptime. BYGGAI may maintain and change the service for security, law, providers or improvement. Material planned interruption or adverse changes are notified where practical; the Customer may cancel before a materially adverse change takes effect.
15. Intellectual property
BYGGAI and licensors retain all rights to epostAI, software, design, documentation, models, trademarks and improvements. The Customer retains Customer data and may use AI output generated for the Customer for internal business purposes. BYGGAI does not warrant that output is unique, copyright-protected or free of third-party rights; use may also be subject to the AI provider's terms. General feedback may be used to improve the service without disclosing confidential or personal data.
16. Confidentiality
Each party must protect non-public business, technical and security information and use it only for the agreement. This does not cover information lawfully public, received from a third party, independently developed or required by law to be disclosed. The other party is notified of compulsory disclosure where permitted. Confidentiality continues for five years after termination; trade secrets remain protected for as long as they legally qualify as secret.
17. Warranties and disclaimer
BYGGAI will provide the service professionally and use reasonable safeguards. It does not warrant error-free or uninterrupted service, correct AI output or fitness for every purpose. The Customer must maintain its own quality control, retention and recovery arrangements in Microsoft 365.
18. Limitation of liability
Neither party is liable for indirect loss, lost profit, revenue, goodwill, expected savings or loss avoidable through reasonable review or backup. Each party's aggregate liability is limited to fees paid for epostAI during the 12 months preceding the event. The limit does not apply where liability cannot lawfully be limited or for wilful misconduct or gross negligence. Unless the order confirmation or DPA expressly sets another liability level, the cap also applies to confidentiality, privacy and IP breaches to the extent permitted by law.
19. Force majeure
Neither party is liable for delay or failure caused by circumstances beyond reasonable control, including major network or power failure, government action, war, natural event, labour dispute or serious critical-cloud-provider failure. The affected party must notify and mitigate where reasonable.
20. Changes
BYGGAI may change terms for future periods. Material changes are notified at least 30 days in advance. The Customer may cancel before a change materially reduces its rights. Security or legally required changes may take effect sooner.
21. Assignment
The Customer may not assign without written consent. BYGGAI may assign in a reorganisation, merger, business sale or transfer to an affiliate if Customer rights and privacy obligations continue.
22. Law and disputes
Norwegian law applies. The parties first attempt negotiation. Unresolved disputes are decided by the ordinary Norwegian courts at BYGGAI AS's business venue, unless mandatory law requires otherwise.
23. Agreement documents
The agreement consists of the order confirmation, special terms, data processing agreement and these terms. Express special terms and the order confirmation prevail over these standard terms. The DPA prevails for personal-data processing. If Norwegian and English texts differ, the Norwegian version prevails.
